Military officials incorporate the Uniform Code of Military Justice along with federal criminal laws in order to define what potential penalties insubordinate members of the armed forces face. Military law was created to govern deployed soldiers as well as change and arrest soldier accused of war crimes. Because the US armed forces are a highly regulated body of individuals who are trained in combat, weapons usage and strategic planning, military law sets a higher standard for conduct than federal laws do. Soldiers must be able to clear federal security clearances in order to be deployed or sent overseas. This means that an enlisted soldier cannot be changed with a crime while off duty. On occasion civilian lawyers are allowed to represent soldiers in cases that involve AWOL charges, suspected drug use and petitions for the correction of military records.

In the military, soldiers are instructed to act ethically, even if it puts them in harms way. Soldiers are not to be involved in fights with civilians unless an incident calls for self defensive action. Allegations of infidelity, spousal abuse, neglect and abandonment are taken very seriously. A soldier can be demoted or possibly dishonorably discharged if a military court finds the party guilty. Because deployed soldiers as well as soldiers that are stationed domestically frequently live in on-base housing the military police take precedence over all other authorities besides the FBI and other branches of federal government. Access to military bases is restricted to the families and authorized visitors of enlisted soldier it is highly unlikely that a civilian will be detained by military police, however, if this does happen then the offending parties will be transferred to police custody.

Discharged soldiers can be charged under military law if it is found that a rule or code was broken while they were enlisted. Military lawyers are enlisted soldier who have attended law school. After passing the bar examination, military lawyers will be trained and educated on military law. They will represent or prosecute soldiers who have accused of a crime. Criminal cases that fall under military law are handled differently than state or federal level cases in the US. Civilians that are accused of aiding and abetting a soldier during the commission of a crime can be charged with a felony under US law. Enlisted soldiers may also be charged under US criminal laws, however, military courts will usually charge and try the accused first. If convicted, soldiers will be fined or sent to military prison.
